By using Speak With Video (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. If any part of these terms is unclear, email info@jmwebpros.com.

We may change these terms at any time. Changes take effect 30 days after we post them, or sooner if you accept them in the Service. If you keep using the Service after changes take effect, you accept the new terms.

Our Privacy Policy explains how we collect and use your information.

The Service relies on third-party services such as YouTube. Your use of those services is governed by their own terms and privacy policies, including the YouTube Terms of Service.

You need an account to use the Service. Keep your login credentials secure, and tell us right away at info@jmwebpros.com if you suspect anyone has used your account without permission. You must be at least 13 years old to use the Service.

You are responsible for what you submit, including YouTube links, chat questions, and flashcards ("Your Content"). You keep ownership of Your Content. You give us permission to store, process, and display it as needed to run the Service. Videos marked as shared library ("base") videos may be visible to other users.

Only submit videos you have the right to use. Transcripts remain subject to YouTube's terms and the rights of their creators. When you delete content, copies may remain in our backups for a limited time.

You agree not to:

• Submit content that is illegal, infringing, defamatory, or harassing.
• Share other people's private information.
• Send spam or upload malware.
• Impersonate others or misrepresent who you are.
• Get around rate limits, security measures, or access controls.
• Scrape the Service or use automated means to access it without our permission.

Explanations in the Service are generated by AI and may be inaccurate or incomplete. Do not rely on them as professional, legal, or authoritative language advice.

We own the Service, including its design, branding, and software. You may use the Service only as intended. You may not copy, modify, reverse engineer, or create derivative works from it. If you violate these terms, we may end your access.

You may link to the Service, but you may not frame it or use our name or branding without our written consent. We are not responsible for third-party websites or for content that other users submit, and we do not guarantee that such content is accurate.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the past 12 months or US$50.

You agree to indemnify us against claims that arise from your use of the Service or your violation of these terms.

We respect intellectual property rights. If you believe content in the Service infringes your copyright, send a notice to info@jmwebpros.com. We may end the accounts of repeat infringers in accordance with the Digital Millennium Copyright Act.

These terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there. You and we each waive any right to bring claims as part of a class or representative action.

We may suspend or disable your access to the Service if you violate these terms.

These terms are the entire agreement between you and Speak With Video about the Service. They replace any earlier agreements.

If you send us feedback or suggestions, you give us all rights to them, and we may use them without any obligation to you.
